CA Insurance Commissioner’s Cousin Charged with Insurance Fraud, Embezzlement Totaling $300,000

Auto insurance claims adjuster Paul Poizner, cousin of California Insurance Commissioner Steve Poizner, has been charged with 60 counts of auto insurance fraud and embezzlement, the Los Angeles Times reported.

Paul Poizner, an adjuster for California Casualty Management, is accused of submitting auto claims totaling more than the repair cost and pocketing the difference – an estimated $300,000. The scheme was discovered during a California Casualty audit of claims submitted between May 2008 and February 2009.

The Department of Insurance was informed of California Casualty’s findings in March, and Steve Poizner recused himself from the investigation.

Paul Poizner pleaded not guilty to the charges on Jan. 22 and had bail set at $294,000.

Okay, this is very sad. They need to add "spell check" in the comments section. It was very hard to read through some of these comments with the poor grammar and mis spelled words.

yes this sound familiar. I see comments and i just could not stand some of you. I am fifty years old now i had open my shop and i quite the business because of this Kik backs I felt it is wrong to do it . my partner continued the business and been doing good he has been investigated for bribes and many other things but still doing great owns many properties and can afford Cuban Cigar's and Champagne, and me in other hand can't even get a job . i am struggling to survive. So who is wrong here? well the truth is do what ever it takes just don't get caught if you do you better have saved enough money to bail your self out. that is our system. WELL IF A SHOP IS IN BUSINESS BIG OR SMALL ARE AND WILL DO IT IF THEY WANT TO STAY IN BUSINESS AND NO ONE WILL OR CAN STOP IT. INVESTIGATERS NEED WORK TO IF THIS STOPS WHAT WILL THEY DO? ONLY THE REASON MR POISONER GOT CAUGHT DUE TO HIS COUSIN BEING THE COMMISSIONER , IT WAS INTIMATED. HOW ABOUT EVERY ONE ELSE?

it happens at every big shop across the country the hole drp prosess is set up for people to abuse there needs to be some one in charge of this stuff that is honest every one wants to get rich well this is the wrong industry

This is a craime and he should be get all he has coming to him. I owna facility that does alot of DRP work and do everything by the book. It is hard work but it can be done and I have never had to engage in illegal practices. I dont make the high profit but I do make a good honest living that I am proud of.

PROGRESSIVE,GEICO,STATE AUTO,GRANGE CAN ALL KISS MY A$$. THEY TRY TO TELL THE SHOP HOW TO REPAIR CARS, BLENDING IS A NESASARY REPAIR PROCEDURE.

I agree, the shops that this guy dealt with are involved in this scam and i bet there sweating bullets about now, scared this guy gonna roll over on them to some how lightin his sentence, if he gets one!

I work in the industry and perform the same job. Angel. That is just a stupid comment. Don. You have got to be kidding. That would be like letting convicts decide their own sentence. Carol. That is not how it works. The estimate for damages needs to match the check less any applicable deductible. Meaning the estimate would need to be over written with the shops' knowledge a check provided to the shop and in return the shop kicks back a percentage. My guess is someone at one of the shops got cut out of the game and snitched.

I have seen kick backs ,, favoritism, conflicts of intersts between insurance agents and shops here for years. I think it is bad,and the body shop business is gone to he**(double golf clubs),because of this and because of steering jobs to some shops. prosicute the jerks, but , in the long run, it will not make any difference. I do not think, after 30 years of this trade ,you are going to fix anything. I would not even think of starting a body shop in todays world. You have more regulations, and insurance companies working against you.

The only unfair practic I've seen is Geico. If you are not a Geico shop, You dont fix anything Geico writes,And if by chance you do the numbers are very low, They write a ton of claims eveywhere. How many do you repair?

I agree with Sam why is it that some shops have sooooo much work and others dont. I know a shop that allows an adjuster to work out of his shop using his personal office to do estimates of course the people are going to stay with his shop since they are already there.

How many shops do you know that pay off adjusters? $200 a car, 5 a day, 5 days a week is over 200k a year. Everyone wants a piece of it. How many deductibles didn't you collect? Its ALL the same.

How was he getting paid teh excess repair $$ ? It doesn't impliment any shops. Shops would have to collect & do a kick back to him. So I wonder who & where they are in all this. If shops get brought into it, it opens more than embezzlement charges. BAR would have a field day auditing repairs done at the shops Poizner's worked "close" to.

If everyone played fair it would solve most problems in the claim process. There are too many personalities involved when dealing with shops and insurance companies. But you all know that will never happen. There are good companies and bad shops. Just hope your dealing with the first, and you don't resemble the last!
