The Wisconsin Assembly is considering a bill that would prohibit auto insurers from requiring that claimants have auto body damage repaired at a particular shop. Currently, Wisconsin law prohibits insurers from requiring that auto glass damage be repaired at a particular facility.
Under A.B. 121, the insurer also must confirm that the claimant hasn’t selected a collision repair facility before recommending a shop. The bill also requires that estimates and insurance cards contain a notice stating that insurance companies can’t require that repairs be made by a particular repair facility, and a similar notice must be posted in body shops and insurance claim facilities.
Insurers would also be required to cover all “reasonable and necessary” repair costs, regardless of which facility a claimant selects. Finally, the bill prohibits insurance adjusters from preparing vehicle damage estimates and from altering estimates prepared by other parties without first performing physical damage inspections.
