Montana repairers will have an upper hand on insurers when it comes to negotiating repair costs now that Gov. Brian Schweitzer has signed H.B. 265 into law. The new law will make it more difficult for insurers to avoid paying for necessary repair procedures.
Specifically, the bill prohibits insurers from disregarding a repair operation or cost identified by an estimating system that the insurer and collision repairer have agreed to utilize in determining the cost of repair.
The American Insurance Association (AIA), State Farm Insurance and Farmers Insurance Group opposed the bill during committee hearings earlier this year.
