Infinity Insurance Settles Short-Pay Lawsuit with Gunder’s Auto Center

Lakeland, Fla., body shop receives two settlement checks for more than $2,000 for non-payment of 'fair and reasonable' labor rates.

Infinity Insurance has reached an official settlement of a short-pay lawsuit that was filed by Ray Gunder of Gunder’s Auto Center.

On behalf of a customer, the Lakeland, Fla.-based shop co-founder took legal action against the insurance company for non-payment on “fair and reasonable” labor rates. This resulted in what Gunder calls a “short-pay victory” with the company, as his attorney, Brent Geohagen, received two settlement checks amounting to more than $2,000 each.

In another legal battle with Allstate, Gunder recently entered a motion for default against the insurance company for failing to respond to his complaint within the required time limit. As with the Infinity Insurance case, the complaint was filed for non-payment of required labor rates that the body shop considers “fair and reasonable.”

Geohagen has also been successful in two other cases against Security National and 21st Century, in which he represented Collision Concepts in Delray Beach, Fla.
