Consumer Protection and Vehicle Safety Bill Introduced in Michigan House of Representatives

Northern Michigan Body Shop Association believes legislation will result in safe and proper vehicle repairs with no interference from insurers.

Legislation that the Northern Michigan Body Shop Association (NMBSA) was instrumental in pushing over the last two years was heard in the Michigan House of Representatives on April 30.

House Bill 4635 seeks to ensure that a vehicle is repaired according to manufacturer specifications without insurers controlling the process to reduce costs.

In addition to featuring some anti-steering components, the bill says an insurer shall not:

• Specify a non-original equipment manufacturer aftermarket crash part in the repair of the damaged automobile if the part is not certified by a national testing board to guarantee quality, fit and crashability.

• Place a limit on the maximum cost of paint or other materials required to repair the damaged automobile.

• Specify the use of a particular vendor to procure a part or other material necessary for the satisfactory repair of the automobile.

• Disregard a repair facility’s posted labor rate without proof of the range of posted door rates available to the public in the market.
