Earl Tindol Body Shop of Gastonia, N.C., will have to pay $135,000 to a couple whose vehicle was improperly repaired by the shop.
A jury found the shop liable for breach of contract, fraud and damages. According to an article in the Gaston Gazette, unresolved issues could force the shop to pay an additional $80,000 plus the couple’s attorney fees.
The vehicle was a 2008 Honda Odyssey. According to Billy Walkowiak of Collision Safety Consultants, after repairs, the unibody was still off 11 millimeters, the floor pan had chisel holes where the shop had tried to beat it out, a rail was sectioned that should not have been, and payment was made for procedures that were not performed. Also, no corrosion protection, weld thru primer or seam sealer was applied, and there was hidden damage in the rear quarter panel.
